OVERVIEW This website is operated by Kohlweiss Vitality Ventures e.U. Throughout the site, the terms "we", "us" and "our" refer to AGEFIT. By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions. These Terms of Service apply to all users of the site, including browsers, vendors, customers, merchants, and contributors of content.

SECTION 1 – ONLINE STORE TERMS By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country of residence, or that you have given us your consent to allow any of your minor dependents to use this site. You may not use our products for any illegal or unauthorized purpose.

SECTION 2 – GENERAL CONDITIONS We reserve the right to refuse service to anyone for any reason at any time. We are not responsible for any harm resulting from third-party access to information you transmit using our services. You agree not to reproduce, duplicate, copy, sell, or exploit any portion of the Service without express written permission from us.

SECTION 3 – PRODUCTS AND SERVICES Our products are manufactured through Print-on-Demand partners. We have made every effort to display as accurately as possible the colors and images of our products that appear in the store. We cannot guarantee that your computer monitor's display of any color will be accurate. Production times may vary depending on the product and partner. We reserve the right to limit the sales of our products to any person, geographic region, or jurisdiction.

SECTION 4 – RIGHT OF WITHDRAWAL (EU/EEA CONSUMERS) If you are a consumer residing in the European Union or EEA, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you, or a third party designated by you, takes physical possession of the goods.

Exceptions: The right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalized (e.g., custom Print-on-Demand products). Most of our products fall under this exception as they are produced individually upon order.

SECTION 5 – RETURNS & REFUNDS (US & CANADA) For customers in the United States and Canada, we handle returns and refunds on a case-by-case basis. As our products are custom Print-on-Demand items produced individually per order, we generally do not accept returns due to buyer's remorse. However, if your product arrives damaged, defective, or incorrect, please contact us within 30 days of delivery at support@agefit.co and we will arrange a replacement or refund.

SECTION 6 – ACCURACY OF BILLING AND ACCOUNT INFORMATION You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information so that we can complete your transactions and contact you as needed.

SECTION 7 – PRICES AND PAYMENTS Prices for our products are subject to change without notice. All prices are displayed inclusive of applicable VAT where required by law. We reserve the right to modify or discontinue the Service at any time without notice. For US customers, applicable state sales tax may be added at checkout where required by law.

SECTION 8 – DATA PROTECTION The processing of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. We process personal data in accordance with the EU General Data Protection Regulation (GDPR), applicable Austrian data protection law (DSG), the California Consumer Privacy Act (CCPA), and Canadian privacy legislation (PIPEDA / Quebec Law 25).

SECTION 9 – CONSUMER PROTECTION

  • EU/Austria: Mandatory provisions of Austrian consumer protection law (KSchG) and EU consumer protection directives apply and are not affected by these Terms.
  • United States: Nothing in these Terms limits any rights you may have under applicable US federal or state consumer protection laws.
  • Canada: Nothing in these Terms limits any rights you may have under applicable Canadian federal or provincial consumer protection laws, including Quebec's consumer protection legislation.

SECTION 10 – DISPUTE RESOLUTION We encourage you to contact us first at support@agefit.co to resolve any dispute amicably.

  • EU consumers: The European Commission provides an ODR platform at https://ec.europa.eu/consumers/odr.
  • US consumers: Any disputes not resolved informally may be subject to binding arbitration under the rules of the American Arbitration Association, except where prohibited by applicable law.
  • Canadian consumers: Disputes shall be resolved in accordance with applicable Canadian law. Quebec consumers retain all rights under Quebec consumer protection legislation.

SECTION 11 – GOVERNING LAW These Terms are governed by the laws of Austria and applicable EU regulations. For consumers, the mandatory consumer protection provisions of your country of residence remain unaffected regardless of this choice of law.

SECTION 12 – CHANGES TO TERMS OF SERVICE We reserve the right to update, change, or replace any part of these Terms of Service by posting updates on our website. It is your responsibility to check this page periodically for changes.
